Families file wrongful death suit 
in fatal crash
Hearing on freezing former doctor’s assets set for Friday

WAUKESHA - Two of the families affected by the crash that killed two people and an unborn child, and injured another person in Oconomowoc on April 25 are suing the man accused of causing the collision by driving while intoxicated.

The families of former Oconomowoc High School Associate Principal Jennifer Bukosky and her daughter, Courtney Bella, and unborn child, Sophia, as well as that of Deborah Gibbs, a 10-year-old girl injured in the crash, filed suit against former Dr. Mark Benson just before 11 a.m. Wednesday.

Bukosky was northbound at a stoplight on Highway 67 at Pabst Road on April 25 when Benson, allegedly intoxicated by prescription medications, slammed his Cadillac Escalade into the back of the car carrying Bukosky, the children and unborn child. Bukosky was pronounced dead the scene, and Bella, 10, was disconnected from life support the next day. Gibbs was released from the hospital a week later. Another child, Zachary Bella, 12, sustained minor injuries.

Benson was charged with three counts of homicide by the intoxicated use of a vehicle, as well as two counts of causing injury by operating while intoxicated and operating after revocation. He was ordered held on $1 million cash bail. The revocation charge stemmed from Benson driving two days after his license was revoked for his third OWI, court records indicated.
