WAUKESHA - The family of a teen killed in a car crash in 2003 has lost their appeal seeking to hold their insurer liable for compensation in his death.

The District II Court of Appeals on Wednesday ruled that Brian Zillmer, 17, did not have permission to use the car in the crash, and thus his mother’s insurer was not liable for uninsured motorist coverage.

Ernest Zillmer, Cynthia Zillmer and the estate of Brian Zillmer sued Cynthia Zillmer’s insurer, American Family Mutual Insurance Group, seeking compensation.
