WaterView Condominiums appealed to Waukesha County Circuit Court

WAUKESHA — After being denied in March by a hearing examiner and one appeal denied by the Oconomowoc Plan Commission in June, WaterView Condominiums and developer Peter Renner have filed a civil suit against Oconomowoc.

The suit was anticipated as it was the next step in the appeal process for Renner and his development.

“The Petitioners are aggrieved by the decision of the Plan Commission, as it denied the Petitioners’ development of the Site,” the suit states.

WaterView Condominiums is a planned nine-unit project sat on 517-525 N. Lake Road in Oconomowoc. The property is zoned as Isthmus Resident Multi-Family. However, the city requires developments within the area to architecturally have matching buildings, scale, design, configuration, details, material and color which reflect practices common in the period between 1870 and 1930.

The petitioners in the suit — WaterView Condominiums LLC and TPW Land LLC — are seeking review of the decision from the commission.

“Its decision in denying the plans was arbitrary, oppressive, and unreasonable, and it represented its will and not its judgement, and it could not reasonably make the determination in question on the evidence before it,” the suit states.

As part of the relief, the petitioners are seeking a review of the denial of the application and to remand the matter back to the Plan Commission with direction to approve the application.
