Attorney says warrant flawed 
in Tomahawk slaying

MERRILL -The attorney for an 18-year-old Tomahawk man charged with killing a convenience store clerk says police acted improperly during a search.

Derek K. Domke is charged with first-degree intentional homicide in the killing of 25-year-old Rochelle Anderson.

Anderson was beaten and stabbed to death March 22 outside the Zephyr Fuel convenience store in Tomahawk where she was working.

Investigators conducted a search at Domke's apartment May 14, hours after Tomahawk Police Chief Don Johnson learned that Domke's palm and finger prints matched those found in blood in the gas station bathroom.

Domke's attorney, Robert Rusch, attempted Tuesday to discredit the results of the search warrant, saying that officers collected evidence outside of what the warrant allowed.

A ruling is expected before the five-day trial begins on Oct. 20.
