Marshfield man will face
trial in buggy death

September 25, 2009

WAUSAU - A Marshfield man accused of crashing into a horse-drawn buggy and killing an infant will face trial on charges of negligent homicide.

A Marathon County judge made the decision Thursday. Prosecutors say 49-year-old Brian Witkus was driving his van Aug. 12 when he crashed into a buggy driven by an Amish family.

Six-week-old Ada Mae Miller was ejected from her mother's arms. Her father said in court that the family tried to revive the girl, but could not and called 911. The baby was pronounced dead at a hospital.

According to the criminal complaint, Witkus told one investigator he had taken the prescription pain reliever Hydrocodone earlier in the day and "blinked" and then struck the buggy. He told another officer the crash happened when he reached down to the floor of the minivan to pick up a book.
