MADISON - Brown County District
Attorney John Zakowski says he has disciplined an employee
whose oversight resulted in the dismissal of a third-offense
drunken driving conviction.
Appeals Court Judge Gregory
Peterson this week blasted the state for repeatedly failing
to respond to Brian Cayce's (kay-SEE) appeal of his 2008
conviction.
Cayce, of Green Bay, argued
that first-offense operating while intoxicated should not
count against repeat drunken drivers as a prior conviction
because it is not a crime.
Peterson called the dismissal
drastic but appropriate given the state's egregious conduct
in failing to respond.
Zakowski said there's no
excuse for what happened and the discipline was handled
internally.
